Declarations of Interest

If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.

 

At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.

 

Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.

 

Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee.

The Committee has considered an application for the grant of a premises licence under the Licensing Act 2003 for the sale by retail of alcohol - off the Premises only (“the Application”)

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to Refuse the application.

 

A copy of this Committee’s full decision including its reasons will be sent to the parties forthwith.

 

If the Applicant is unhappy with the decision, they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision

The Committee has considered an application for the grant of a premises licence under the Licensing Act 2003 for the sale by retail of alcohol - off the Premises only (“the Application”)

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to:

 

1.    Grant the application as submitted

 

  1. The licence is subject to the conditions in the application, the Council’s mandatory conditions and the further following conditions taken from the Council’s pool of conditions:

 

-          Strong beer and cider above 5.5% ABV shall not be displayed or sold

 

-          Single cans or bottles of beer or cider shall not be sold.

 

-          The premises shall operate a Challenge 25 age restricted sales policy and shall display appropriate signage advising customers of this policy.

 

-          All staff shall be trained in the Proof of Age policy and how to identify acceptable means of identification.

 

-          Posters shall be displayed in prominent positions around the premises advising customers of the Proof of Age policy in force at the premises.

 

-          A telephone number for the premises, or a responsible member of staff on duty, shall be displayed so that it is visible from the public highway for members of the public to lodge complaints.

 

 This licence becomes operational with immediate effect.  If problems are experienced, then an application for a review of the premises licence can be made.

 

A copy of this Committee’s full decision including its reasons and the full text of the conditions added to the licence will be sent to the parties forthwith.
