Cabinet approval is sought for the final 'CIL
regulation 123 list.' ('the r123 list') needed for the
implementation of the borough's Community Infrastructure Levy.
Cabinet has previously approved a draft version of the r123 list in
August 2014 as part of the wider public consultation on the draft
Community Infrastructure Levy charging schedule.
The r123 list is prepared under regulation 123 of the Community
Infrastructure Levy Regulations 2010 (as amended). The list details
the infrastructure projects or types of infrastructure that the
council intends can be funded wholly or partly by CIL.
The r123 list forms an important part of the borough CIL. It
enables S106 planning obligations to be sought in parallel with the
borough Community Infrastructure Levy ('CIL'). S106 planning
obligations cannot be sought for items that are listed in the r123
list as these items will be funded by CIL. This ensures that
developers do not pay twice for the same infrastructure via both
CIL and S016 obligations.
If a r123 list is not approved and published, the council will not
be able to use S106 planning obligations to secure any
infrastructure.
