The Council is under a duty to make revisions
to its statement of licensing policy at such times as it considers
necessary and appropriate. Following an extensive evidence
gathering period the Council considers it may be necessary and
appropriate to introduce a special policy in relation to cumulative
impact. The effect of adopting such a policy would be to create a
rebuttable presumption that applications for new premises licences
or club premises certificates or variations that are likely to add
to the existing cumulative impact will normally be refused, where a
relevant representation has been made, unless the applicant can
demonstrate that there will be no negative cumulative impact on one
or more of the licensing objectives.
