Decision:

The Committee has considered an application for a new premises licence for the sale of alcohol off the premises for the Ground Floor (Food and Wine Store), sale of alcohol on and off the premises and the provision of late-night refreshment for the Basement floor (Restaurant) under the Licensing Act 2003 (“the Application”).

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to

 

1.                  Grant the Application in part as follows:

 

Ground Floor (Food and Wine Store)

The sale of alcohol - Off the premises only

Sundays to Thursdays between the hours of 10:00 to 23:30

Fridays and Saturdays between the hours of 10:00 to 00:30

 

Basement Floor (Restaurant)

The sale of alcohol - Both on and off the premises

Sundays to Thursdays between the hours of 14:00 to 23:30

Fridays and Saturdays between the hours of 14:00 to 00:30

 

The provision of late-night refreshment - Both indoors and outdoors

Sundays to Thursdays between the hours of 23:00 to 23:30

Fridays and Saturdays between the hours of 23:00 to 00:30

 

2.                  The opening hours of the premises (Both Floors) are

Sundays to Thursdays between the hours of 08:00 to 00:00

Fridays and Saturdays between the hours of 08:00 to 01:00

 

3.                  The licence is subject to any mandatory conditions

 

4.                  The licence is subject to the conditions volunteered by the Applicant in the operating schedule

 

5.                  The licence is subject to the conditions proposed by the Police and agreed by the Applicant

 

6.                  The licence is also subject to conditions imposed by the Committee

1.       All external doors and windows shall be kept closed at all times save during access and egress.

 

2.       External doors shall be fitted with a self-closing device that is maintained in proper working condition, and which shall not be propped open at any time.

 

 

 

This licence becomes operational with immediate effect.  If problems are experienced, then an application for a review of the premises licence can be made.

 

A copy of this Committee’s full decision including its reasons will be sent to the parties forthwith.

 

If the Applicant or any person who has made a relevant representation is unhappy with the decision they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision.
