Declarations of Interest If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.
At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.
Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.
Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee. |

Decision: The Committee has considered an application for a variation of the existing premises licence for extending the hours for late night refreshment and opening hours to the public, to amend existing condition 11 attached to the licence and to replace the existing plan under the Licensing Act 2003 (“the Application”).
In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to:
1. Grant the hours for late night refreshment as follows:
Late-Night Refreshment – indoors ordering service only Monday to Sunday 23:00 to 01:00 Late-Night Refreshment: Delivery service only Monday to Sunday 23:00 to 03:00
2. The hours the Premises is open to the public as follows:
Monday to Sunday 11:00 to 01:00 Delivery only after 01:00, when the premises is closed to the public
3. Agree to amend the existing condition 11
4. Agree to replace the existing plan
5. To impose the conditions proposed by the Applicant in the operating schedule as amended by the Committee.
6. To amend the existing conditions attached to the Licence as agreed by the Applicant at the hearing.
7. To add a condition to the licence regarding staff being trained in the sale of alcohol, Licensing Act and the conditions of the Premises Licence.
A copy of this Committee’s full decision including its reasons will be sent to the parties forthwith.
If the Applicant or any person who has made a relevant representation is unhappy with the decision they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision.

Decision: The Committee has considered an application for a new premises licence for the provision of late night refreshment both indoors and outdoors and the sale of alcohol both on and off the Premises under the Licensing Act 2003 (“the Application”).
In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to:
1. Grant the Application as follows:

Sunday to Thursday 23:00 to 00:00 Friday and Saturday 23:00 to 01:00
Non-Standard timings: an additional hour on Christmas Eve/Boxing Day/Monday Thursday/Sundays preceding Bank Holiday Mondays/New Year's Eve/the morning BST commences.
Sale of Alcohol - On and Off the Premises
Sunday to Thursday 09:00 to 23:30 Friday and Saturday 09:00 to 00:30
Non-Standard timings: an additional hour on Christmas Eve/Boxing Day/Monady Thursday/Sundays preceding Bank Holiday Mondays/New Year's Eve/the morning BST commences.
2. The opening hours of the premises are as follows:
Sunday to Thursday 08:00 to 00:00 Friday and Saturday 23:00 to 01:00
3. The licence is subject to any mandatory conditions.
4. The licence is subject to the conditions volunteered by the Applicant in the operating schedule as amended at the hearing.
5. To impose conditions to the licence as agreed at the hearing as follows:
1. There shall be no sale of alcohol for the consumption outside the Premises except for the external terrace area of the Premises.
2. A responsible member of staff shall organise and accommodate meetings to discuss the operation of the premises with residents at least two times per calendar year. The meeting shall be advertised at least 14 days before its due date by letter to residents and residents’ associations in the locality as well as to the Licensing Authority.
3. A condition about being part of a local pubwatch scheme.
This licence becomes operational with immediate effect. If problems are experienced, then an application for a review of the premises licence can be made.
