Declarations of Interest

If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.

 

At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.

 

Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.

 

Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee.

Decision:

The Committee has considered an application for a new premises licence for the sale of alcohol on and off the premises and the exhibition of films indoor only under the Licensing Act 2003 (“the Application”).

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to: 

 

1.                  Grant the Application as follows:

 

The exhibition of films - Indoors Only

Mondays to Sundays from 08:00 to 23:00

 

Sale of alcohol both on and off the Premises

Mondays to Sundays from  10:00 to 23:00

 

2.                  The opening hours of the premises are as follows:

 

Mondays to Sundays from 07:00 to 23:30

 

3.                  The licence is subject to any mandatory conditions

 

4.                  The licence is subject to the conditions volunteered by the Applicant in the operating schedule. 

 

5.                  The licence is subject  the following conditions imposed by the Committee as follows:

 

1.    All rear external doors and windows shall be kept closed at all times between 20:00 to 23:00 during licensable activities, save during access and egress.

2.    A responsible member of staff shall organise and accommodate meetings to discuss the operation of the premises with residents at least two times per calendar year. The meeting shall be advertised at least 14 days before its due date by letter to residents and residents’ associations in the locality as well as to the Licensing Authority. 

3.    A responsible member of staff shall take the minutes of meetings with residents that shall be circulated to all attendees and to the Licensing Authority and copies shall be readily available at the premises on request.

4.    A record of complaints shall be maintained on the premises to record details of any complaints received. The information to be recorded shall include the date and time of complaint and subsequent remedial action undertaken and (where disclosed) the complainant’s name and location. 

5.    The record of complaints shall be kept for 12 months from the date of the last record made and shall be available for inspection on demand by the Police or  authorised officers of the Licensing Authority at all times the premises are open.

 

 

This licence becomes operational with immediate effect.  If problems are experienced, then an application for a review of the premises licence can be made.

 

A copy of this Committee’s full decision including its reasons will be sent to the parties forthwith.

 

If the Applicant or any person who has made a relevant representation is unhappy with the decision, they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision.
