If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.

At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.

Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.

Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee.

The Committee has considered an application for a new premises licence for the sale of alcohol off the premises and to operate as an off licence and convenience store under the Licensing Act 2003 (“the Application”).

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to

1.       Grant the application in part as follows

Sale of alcohol – off the Premises

Monday to Saturday 10:00 – 22.30

Sunday 10:00 - 21:00

The opening hours of the premises

Monday to Sunday 08:00 - 23:00

2.       Add the following conditions agreed by the Committee:-

1. No alcohol deliveries shall be made from the premises.

2.  All display units for alcohol shall have lockable shutters.

3. Shutters shall be closed and locked at the end of the permitted hours for the sale of alcohol, and shall not be unlocked again whilst the premises is open until the start of the permitted hours on the following day.

This licence becomes operational with immediate effect.  If problems are experienced, then an application for a review of the premises licence can be made.

A copy of this Committee’s full decision including its reasons and the full text of the conditions added to the licence will be sent to the parties forthwith.

If the Applicant is unhappy with the decision they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision

Under Section 100A (4) of the Local Government Act 1972, that the public and press be excluded from the meeting during the consideration of the following items of business, on the grounds that they contain the likely disclosure of exempt information, as defined in paragraph 3 of Schedule 12A of the said Act, as it contains information relating to the financial or business affairs of any particular person (including the authority holding that information).

The Committee has considered the variation of a street trading licence under the London Local Authorities Act 1990 (“the Application”).

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case to

1.                  Approve the officer recommendation set out in the report.

If the Applicant is unhappy with the decision they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision
