Declarations of Interest

If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.

 

At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.

 

Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.

 

Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee.

Decision:

The Committee has considered an application for the grant of a premises licence under the Licensing Act 2003 for the provision of  sale of alcohol off  the Premises (“the Application”)

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to:

 

1.       Grant the Application as follows:

 

The sale of alcohol off the premises only

Mondays to Sundays 08:00 to 23:00

 

 

 

  1. The opening hours of the premises  are

Mondays to Sundays 08:00 to 23:00

 

  1. The licence is subject to any mandatory conditions

 

  1. The licence is subject to  the conditions volunteered by the Applicant in the operating schedule as amended by the Committee

 

  1. The licence is subject to the conditions imposed by the Trading Standards Officer  and agreed by the Applicant

 

  1. The licence is also subject to one condition imposed by the committee : “Single cans or bottles of beer or cider shall not be sold.”

 

 

 This licence becomes operational with immediate effect.  If problems are experienced, then an application for a review of the premises licence can be made.

 

A copy of this Committee’s full decision including its reasons and the full text of the conditions added to the licence will be sent to the parties forthwith.

 

If the Applicant is unhappy with the decision they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision

Decision:

The Committee has considered an application for the variation of a premises licence to amend the  layout of the premises plans of the existing licence  and increase the area for licensable activities to include the first floor of the Premises under the Licensing Act 2003 (“the Application”).

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to

 

1.                         approve the changes to the layout of the Premises plans

 

 

2.                         To impose further conditions in the Licence summarised as follows; the first floor area to be closed for licensable activities by 22:30 and for customer to leave that area by 23:00, the windows in the first floor area to be closed by 21:00, only background music to be played on the first floor, proactive noise assessment outside the premises and keeping a written record, a telephone number of the premises to be displayed for residents to lodge complaints, a responsible member of staff to organise and accommodate meetings to discuss the operation of the premises with residents at least one time per calendar year

 

3.                         The existing condition about complaints book to be amended to include complaints  specifically about noise and/or rowdy behaviour.

 

 

 This licence becomes operational with immediate effect.  If problems are experienced, then an application for a review of the premises licence can be made.

 

A copy of this Committee’s full decision including its reasons and the full text of the conditions added to the licence will be sent to the parties forthwith.
