Declarations of Interest

If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.

 

At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.

 

Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.

 

Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee.

Decision:

The Committee has considered an application for the grant of a premises licence under the Licensing Act 2003 for the provision of late night refreshment (“the Application”)

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to reject the application.

 

A copy of this Committee’s full decision including its reasons will be sent to the parties forthwith.

 

If the Applicant is unhappy with the decision, they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision.

Decision:

The Committee has considered an application for a new premises licence under the Licensing Act 2003 (“the Application”).

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives: 

 

1.                  To grant the application by imposing the licensable hours proposed by the Police and agreed by the Applicant 

 

2.                  Opening Hours of the Premises are as follows;

 

Sundays to Wednesdays 08:00 to 23:30

Thursdays - Saturdays 08:00 to 00:30

 

3.                  To impose conditions proposed by the Police and agreed by the Applicant as amended by the Committee.

 

4.                  To impose conditions proposed by the Noise and Nuisance Department and agreed by the Applicant.

 

5.                   To impose conditions proposed by the Applicant in the operating schedule and the supplementary agenda as amended by the Committee. 

 

6.                  The Applicant shall submit within 14 days to the Licensing Authority an amended plan excluding the public highway from the premises licence.

 

 

A copy of this Committee’s full decision including its reasons and the full text of the conditions added to the licence will be sent to the parties forthwith.
