Declarations of Interest If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.
At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.
Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.
Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee. |

Decision: The Committee has considered an application for the variation of a premises licence to allow for provision of late night refreshment for take away Sunday to Monday 23:00 - 04:00 and Friday to Saturday 23:00 - 05:00 and to make changes to condition 6 attached to Annex 2 of the existing Licence under the Licensing Act 2003 (“the Application”).
In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to
1. Approve the Application in part as follows
Provision of Late Night Refreshment -Outdoors Sunday to Monday 23:00 - 04:00 and Friday to Saturday 23:00 - 05:00
2. Impose three conditions proposed by Police and agreed by the Applicant
3. Impose a condition about training of staff, litter and removal of table and chairs after 02:00
4. Amend condition 18 to Annex 2 of the existing Licence to Challenge 25 condition.
This licence becomes operational with immediate effect. If problems are experienced, then an application for a review of the premises licence can be made.
A copy of this Committee’s full decision including its reasons and the full text of the conditions added to the licence will be sent to the parties forthwith.
If the Applicant is unhappy with the decision, they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision. |

Decision: The Committee has considered an application for the variation of a premises licence to extend the hours for the sale of alcohol, amend the hours the premises is open to the public, to add late night refreshment as well as amend the layout of the premises under the Licensing Act 2003 (“the Application”).

1. Approve the Application in part as follows: -
Provision of Late Night Refreshment -Both Indoors and Outdoors Monday to Sunday 23:00 - 00:00
Sale of Alcohol Off the Premises Monday to Sunday 06:30 - 00:00
2. The opening hours of the premises Monday to Sunday 06:00 - 00:00
3. Approve the changes to the layout of the Premises
4. Impose the conditions proposed by the Applicant in the operating schedule as amended by the Committee
5. Modify the conditions 7 and 8 proposed by the Applicant in the operating schedule as set out below:
7. Strong beer (including lager stout, ale etc) and cider above 5.5% ABV shall not be sold at the Premises during the hours of 06:30- 08:00 and after 23:00.
8. All sales of alcohol between the hours of 06:30-08:00 and after 23:00 shall be via credit card.
