Declarations of Interest

If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.

 

At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.

 

Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.

 

Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee.

Decision:

The Committee has considered an application for a new premises licence under the Licensing Act 2003 (“the Application”)

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to:

 

 

Grant the application in full with the agreed conditions with the Health and Safety Team and the revised conditions as listed in updated supplementary agenda with the additional modification to the following conditions:

 

1.    Modify condition 10 to now read as “Town Radio Link shall be in operation in the restaurant, where available, during the times that licensable activities are taking place.”

 

2.    Modify Condition 25 to add an additional requirement at point (iii) that customers do not park their cars or eat in the residential streets behind the premises

 

3.    Modify Condition 27 to include litter collection to now include the rear of the premises on Sterne Street

 

4.    Modify condition 30 – to now add the words, “no waste collection shall take place at the rear of the premises but only the front on Uxbridge Road”.

 

5.    To reduce the hours of provision of Late Night Refreshment both indoors and outdoors between Thursday and Saturday from 3 am to 2 am. 

 

6.    To add an additional condition that the door to the rear of the premises onto Sterne Street shall only be used as a fire exit and in emergencies

 

 

 

  1. A copy of this Committee’s full decision including its reasons [and the full text of the conditions added to the licence] will be sent to the parties in due course.

 

  1. If any of the parties are unhappy with the decision they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision
