Roll-call and Declarations of Interest

At the start of the meeting the Chair will carry out a roll-call of committee members to confirm attendance. Members will also have an opportunity to declare any interests.

 

If a Councillor has a disclosable pecuniary interest in a particular item, whether or not it is entered in the Authority’s register of interests, or any other significant interest which they consider should be declared in the public interest, they should declare the existence and, unless it is a sensitive interest as defined in the Member Code of Conduct, the nature of the interest at the commencement of the consideration of that item or as soon as it becomes apparent.

 

At meetings where members of the public are allowed to be in attendance and speak, any Councillor with a disclosable pecuniary interest or other significant interest may also make representations, give evidence or answer questions about the matter. The Councillor must then withdraw immediately from the meeting before the matter is discussed and any vote taken.

 

Where Members of the public are not allowed to be in attendance and speak, then the Councillor with a disclosable pecuniary interest should withdraw from the meeting whilst the matter is under consideration. Councillors who have declared other significant interests should also withdraw from the meeting if they consider their continued participation in the matter would not be reasonable in the circumstances and may give rise to a perception of a conflict of interest.

 

Councillors are not obliged to withdraw from the meeting where a dispensation to that effect has been obtained from the Standards Committee.

Decision:

The Committee has considered an application for the variation of a premises licence under the Licensing Act 2003 (“the Application”)

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to Reject the whole Application.

 

This decision becomes operational with immediate effect.  If problems are experienced, then an application for a review of the premises licence can be made.

 

A copy of this Committee’s full decision including its reasons will be sent to the parties forthwith.

 

If the Applicant is unhappy with the decision, they are entitled to appeal to the magistrates’ court within 21 days from the date of notification of the full decision.

Decision:

The Committee has considered an application for the grant of a premises licence under the Licensing Act 2003 for the sale of alcohol ON the premises  (“the Application”).

 

In summary, the Committee has decided, after taking into account all of the individual circumstances of this case and the promotion of the four licensing objectives to:

 

1.    Grant the application in part as follows:

 

Sale of alcohol - On the Premises Only

Monday to Sunday 11:00 - 19:00

 

2.    That the hours the Premises will be open to public will be as follows:

 

Monday to Sunday 09:00 - 23:00

 

  1. The licence is subject to any mandatory conditions

 

 

  1. Modify the conditions of the licence volunteered by the Applicant in the operating schedule, by altering or omitting or adding them

 

 

  1. Add the conditions proposed by the environmental health officer and agreed by the Applicant

 

This licence becomes operational with immediate effect.  If problems are experienced, then an application for a review of the premises licence can be made.
