This report seeks approval to award a 2-year
contract, with the option to extend for up to 2 further years, to
Sheffield Teaching Hospitals NHS Foundation Trust to provide
toxicology services for the WLCS. The toxicology contract is to be
awarded by the London Borough of Hammersmith and Fulham on behalf
of the WLCS.
That the Strategic Director of Finance and Governance approves:
1. That Appendix 2 is not for publication on the basis that it contains information relating to the financial or business affairs of any particular person (including the authority holding that information) as set out in paragraph 3 of Schedule 12A of the Local Government Act 1972 (as amended).
2. the procurement strategy presented in Appendix 1;
3. the award of a contract to Sheffield Teaching Hospitals NHS Foundation Trust to provide toxicology services for the West London Coroner’s Service, via a direct call off contract from the Eastern Shires Purchasing Organisation (ESPO) Framework for a period of 2 years with the option to extend for up to a further 2 years. The value of the contract, based on current usage, is approximately £100,000 per annum, (and therefore approximately £200,000 for the initial contract period or £400,000 in aggregate if the extension is utilised). The proposed commencement date is 1st of January 2020; and
4. that the Borough Solicitor be granted delegated authority to take all necessary legal and practical steps required in order to complete the contract.
1. The current toxicology provider is currently spot purchased and the costs are increasing year on year. The Council needs to procure a contract in compliance with its Contract Standing Orders and PCR 2015.
2. The Council will call off the Eastern Shires Purchasing Organisation (ESPO) Framework rather than undertake a full tendering exercise as this will reduce the cost to the Consortium boroughs, while complying with the Regulations
3. The framework agreement allows for direct award to the most economically advantageous supplier. Based on the framework pricing schedule, this was University Hospitals Leicester NHS Trust. However, the supplier did not have capacity to provide the services. As a result, the proposed award is to the second ranked supplier.
